INSURANCE CONTRACT
This Insurance Contract (the "Contract") is made and entered into as of this ______ day of __________, ___________ (the "Effective Date"), by and between the following parties:
1. [Insurer's Name], a company organized and existing under the laws of [Jurisdiction], with its principal place of business located at [Insurer's Address] (hereinafter referred to as the "Insurer").
2. [Insured's Name], an individual with a principal residence located at [Insured's Address] (hereinafter referred to as the "Insured").
WHEREAS, the Insured desires to obtain insurance coverage from the Insurer, and the Insurer is willing to provide such coverage, subject to the terms and conditions contained herein;
NOW, THEREFORE, in consideration of the mutual covenants and agreements contained herein, the parties hereto agree as follows:
1. INSURANCE COVERAGE
a. The Insurer agrees to provide insurance coverage to the Insured for the risks and perils described in Schedule A attached hereto (the "Covered Risks").
b. The insurance coverage provided under this Contract shall be effective from the Effective Date and shall continue in force for a period of [Policy Term], unless terminated earlier in accordance with the provisions of this Contract.
c. The insurance coverage provided under this Contract shall be subject to the limitations, exclusions, and conditions set forth in Schedule B attached hereto (the "Exclusions and Conditions").
2. PREMIUMS
a. The Insured agrees to pay the insurance premiums specified in Schedule C attached hereto (the "Premiums") to the Insurer in accordance with the payment terms set forth therein.
b. The Premiums shall be due and payable on the dates specified in Schedule C. Failure to pay the Premiums when due shall result in the termination of the insurance coverage provided under this Contract, unless the Insurer, in its sole discretion, elects to grant an extension of time for payment.
3. CLAIMS PROCEDURE
a. In the event of a loss or damage to the property covered under this Contract, the Insured shall promptly notify the Insurer in writing of such loss or damage, providing full details of the occurrence and the extent of the loss or damage.
b. The Insurer shall, upon receipt of notice of a claim, promptly investigate the claim and determine the amount of the loss or damage, subject to the terms and conditions of this Contract.
c. The Insurer shall, within a reasonable time after determining the amount of the loss or damage, pay or cause to be paid to the Insured the amount of the loss or damage, less any applicable deductibles and subject to the limitations and exclusions set forth in this Contract.
4. EXCLUSIONS
a. The insurance coverage provided under this Contract shall not apply to any loss or damage arising from any of the following:
i. Nuclear reaction, radiation, or radioactive contamination;
ii. War, invasion, act of foreign enemy, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection, military or usurped power;
iii. Intentional damage or destruction by the Insured or any person acting on the Insured's behalf;
iv. Loss or damage resulting from wear and tear, gradual deterioration, inherent vice, or lack of maintenance;
v. Loss or damage resulting from any act or omission of the Insured that is fraudulent or in violation of any applicable law or regulation.
b. The insurance coverage provided under this Contract shall also not apply to any loss or damage arising from any peril not specifically listed in Schedule A attached hereto.
5. CONDITIONS
a. The Insured agrees to comply with all applicable laws and regulations relating to the property covered under this Contract.
b. The Insured agrees to maintain the property covered under this Contract in good condition and to take all reasonable precautions to prevent loss or damage to such property.
c. The Insured agrees to cooperate with the Insurer in the investigation and adjustment of any claim made under this Contract.
d. The Insured agrees to provide the Insurer with such information and documentation as the Insurer may reasonably request in connection with the investigation and adjustment of any claim.
6. TERMINATION
a. This Contract may be terminated by either party upon written notice to the other party.
b. In the event of termination, the Insurer shall refund to the Insured any unearned Premiums, computed on a pro rata basis, for the unexpired portion of the insurance coverage.
c. Termination of this Contract shall not affect any rights or obligations of the parties arising out of or in connection with any claim made prior to the effective date of termination.
7. DISPUTE RESOLUTION
a. Any disputes arising out of or in connection with this Contract shall be resolved by arbitration in accordance with the rules of the [Arbitration Association], and the decision of the arbitrator(s) shall be final and binding upon the parties.
b. The place of arbitration shall be [Jurisdiction], and the language of the arbitration shall be English.
c. The parties agree that any legal action or proceeding arising out of or in connection with this Contract shall be brought exclusively in the courts of [Jurisdiction].
8. MISCELLANEOUS PROVISIONS
a. This Contract constitutes the entire agreement between the parties and supersedes all prior agreements and understandings, whether written or oral, relating to the subject matter hereof.
b. This Contract may be amended or modified only by a written instrument executed by both parties.
c. This Contract shall be binding upon and inure to the benefit of the parties and their respective successors and assigns.
d. This Contract shall be governed by and construed in accordance with the laws of [Jurisdiction].
